Welcome to 24/7 Ambulancesewa. These Terms of Service ("Terms") govern your use of 24/7 Ambulancesewa's emergency medical transport services, website, and mobile application (collectively, the "Services"). By using our Services, you agree to be bound by these Terms and our Privacy Policy.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not use our Services. These Terms constitute a legally binding agreement between you and 24/7 Ambulancesewa ("we," "our," or "us").

2. Service Description

24/7 Ambulancesewa provides emergency and non-emergency medical transport services, including ambulance services and morgue transport. Our Services include:

  • Emergency ambulance transport to medical facilities
  • Inter-facility patient transfers
  • Specialized medical transport (including ventilator-equipped ambulances)
  • Morgue transport services
  • Online booking and scheduling of transport services
  • Related healthcare transport services

The availability of specific services may vary by location and is subject to resource availability, weather conditions, and other factors beyond our control.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our Services on behalf of another person who requires medical transport, you represent that you have the legal authority to act on their behalf.

3.2 Account Registration

Some features of our Services may require you to create an account. When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information you provide is inaccurate, false, or incomplete, or if you have violated these Terms.

4. Service Requests and Bookings

4.1 Emergency Requests

For life-threatening emergencies, we recommend calling the national emergency number (such as 911 in the US) directly. Our online booking system and mobile application are primarily designed for non-emergency transport and scheduled services.

4.2 Booking Process

When you request our Services, you agree to provide accurate and complete information about the patient's condition, pickup location, destination, and any special requirements. Failure to provide accurate information may result in delays, inappropriate resource allocation, or service denial.

4.3 Service Availability

While we strive to provide prompt service, the availability of our Services depends on various factors, including but not limited to resource availability, geographic location, weather conditions, and the nature of the request. We cannot guarantee that Services will be available at all times or in all locations.

4.4 Cancellations

If you need to cancel a scheduled transport, please notify us as soon as possible. Cancellation fees may apply based on the timing of the cancellation and resources already allocated. Emergency dispatches that are en route or on-scene cannot be cancelled without charge.

5. Payment Terms

5.1 Fees and Charges

Our fees vary based on the type of service, distance, time of day, equipment needed, and other factors. We will provide you with information about applicable fees before you confirm your booking, except in emergency situations where service is provided first and billing occurs afterward.

5.2 Insurance and Third-Party Billing

We may bill your health insurance provider for covered services. However, you remain responsible for any charges not covered by insurance, including deductibles, co-payments, and services deemed not medically necessary by your insurance provider. By using our Services, you authorize us to bill your insurance provider on your behalf.

5.3 Payment Methods

We accept various payment methods, including credit cards, debit cards, and electronic funds transfers. By providing payment information, you represent that you are authorized to use the payment method and agree to pay all charges incurred.

5.4 Late Payments

Invoices are due upon receipt. Late payments may incur additional fees and interest charges as permitted by law. We reserve the right to engage collection agencies and pursue legal action for unpaid balances.

6. User Responsibilities

When using our Services, you agree to:

  • Provide accurate and complete information about the patient's condition and medical history
  • Follow the instructions of our medical personnel during transport
  • Treat our staff with respect and refrain from abusive, threatening, or violent behavior
  • Secure any valuables before transport, as we are not responsible for lost or stolen items
  • Provide a safe environment for our personnel to perform their duties
  • Pay for services as agreed
  • Use our digital platforms and applications in compliance with these Terms

By requesting our Services, you (or the legal guardian/authorized representative of the patient) consent to the medical care and treatment provided by our personnel during transport. This includes consent for emergency medical procedures necessary to preserve life or prevent serious impairment.

You authorize our personnel to:

  • Assess the patient's condition and provide appropriate medical care
  • Transport the patient to the most appropriate medical facility based on their condition
  • Share medical information with receiving healthcare providers
  • Obtain medical records relevant to the current treatment

In emergency situations where the patient is unable to provide consent and no authorized representative is available, we will act in the patient's best interest according to medical protocols and applicable laws.

8. Limitation of Liability

To the maximum extent permitted by law, 24/7 Ambulancesewa and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our Services
  • Any conduct or content of any third party on our Services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Delays or disruptions in our Services
  • Viruses or other malicious code transmitted to or through our Services
  • Any other matter relating to our Services

Our liability for direct damages shall be limited to the amount paid by you for the specific service giving rise to the claim, or $1,000, whichever is greater. This limitation does not apply to liability that cannot be excluded or limited by applicable law, such as liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.

9. Indemnification

You agree to indemnify, defend, and hold harmless 24/7 Ambulancesewa and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your provision of inaccurate or incomplete information
  • Your failure to pay for services rendered

10. Intellectual Property

All content, features, and functionality of our website and mobile application, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are the exclusive property of 24/7 Ambulancesewa or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website or mobile application without our prior written consent, except for:

  • Temporary storage of copies solely as necessary to view the material
  • Storage of copies in your computer's cache memory as necessary to view the material
  • Printing reasonable numbers of pages for personal, non-commercial use

11. Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you. By using our Services, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use our Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our Services shall be resolved exclusively in the courts located in Kathmandu, Nepal.

Before filing a lawsuit, you agree to attempt to resolve the dispute informally by contacting us. If we cannot resolve the dispute informally, you and 24/7 Ambulancesewa agree to binding individual arbitration in accordance with the applicable arbitration rules of Nepal, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 24/7 Ambulancesewa regarding our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our Services.

15.2 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be severed from these Terms. Any modification or removal of a provision shall not affect the validity and enforceability of the rest of these Terms.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

15.5 Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, severe weather, civil unrest, terrorist attacks, labor disputes, government actions, or other events of force majeure.
